  • The Qualification Directive creates a ‘status’ called ‘subsidiary protection’.
  • Implemented into domestic law on 9 October 2006 as ‘Humanitarian Protection’ (HP) in the Qualification Regulations and the Immigration Rules.
  • HP builds upon ECHR jurisprudence prohibiting the expulsion of a non-EU national, if it would breach their human rights and the obligations of the state.
  • The Home Office considers HP simultaneously with asylum.
  • Outcomes are the same as for refugee status except that a holder of HP cannot apply for a Refugee Convention travel document.

  • In the United Kingdom or at a port of entry in the United Kingdom
  • Does not qualify as a refugee
  • Not excluded from a grant of humanitarian protection”
  • Substantial grounds have been shown for believing that the person concerned, if ... returned ..., would face a real risk of suffering serious harm and is unable, or, owing to such risk, unwilling to avail himself of the protection of that country
